Pfizer, the world's largest pharmaceutical company, is being sued by its generic competitors because of the failure of U. Patent and Trademark Office (“U. O.”) notices of filing ("FoN.") on its products, and Pfizer’s generic product, Viagra. The U. O. and Pfizer's counsel filed a motion to dismiss, arguing that the U. has failed to adequately warn the public of the possibility of patent infringement and that the Federal Trade Commission (“FTC”) has no jurisdiction to regulate the subject matter of the litigation. In support of its motion, Pfizer and its generic competitors have filed motions to dismiss the claims of the United States, the Federal Trade Commission, and the federal circuit court in Washington, D. (“FTC”). The district court denied the motion, and Pfizer appeals. We affirm.
Pfizer is a New York, New York-based pharmaceutical company with its headquarters in New York City. O.’s trademark, “Sig. 00-1299” is a trade name for the use of a drug (sildenafil citrate) that is approved by the U. in the U. and for a duration of 30 days, for the treatment of erectile dysfunction, and is the generic name for Viagra. O.’s generic product, “Viagra Connect”, was launched in Europe in November 2011, and U. O.’s generic product, “Viagra Soft”, launched in January 2012. Under the mark Pfizer’s trademark “Sig. 00-1549” is a generic version of the same active ingredient, sildenafil citrate, as well as a generic version of the same active ingredient, tadalafil. It is also known as the generic drug of the same name and is the generic drug of the same name. O.’s trademark “Viagra Soft” is a generic version of the same active ingredient, tadalafil, and is the generic drug of the same name. O.’s generic product, “Viagra Connect” is also known as the generic drug of the same name and is the generic drug of the same name. Pfizer’s trademark “Sig. 00-1549” is a generic version of the same active ingredient, tadalafil, as well as a generic version of the same active ingredient, sildenafil citrate.
